These Terms of Use ("Terms") govern your access to and use of the merchants.omnicliq.com website ("Service"), operated by Omnicliq Digital Agency. By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Service Description

Omnicliq Merchants is a comparison shopping service (CSS) that allows consumers to compare product prices and offers from various online merchants. Our Service aggregates publicly available product information -- including product names, descriptions, images, prices, and availability -- from participating merchants and displays them in a structured, searchable format.

We do not sell products. We are not a retailer, marketplace, or intermediary. All purchases are made directly on the respective merchant's website, and we are not a party to any transaction between you and a merchant.

2. How It Works

Our Service operates as follows:

  • We collect and display product information and prices from various online merchants.
  • You can search for products, compare prices, and filter results to find the best offers.
  • When you find a product you wish to purchase, you click on the merchant's offer, which redirects you directly to the merchant's website.
  • The purchase, payment, delivery, and any after-sales service are handled entirely by the merchant.

3. Accuracy of Information

We make reasonable efforts to ensure that the product information displayed on our Service is accurate and up to date. However:

  • Prices, availability, shipping costs, and product specifications are subject to change at any time by the merchant.
  • There may be a delay between when a merchant updates their information and when it is reflected on our Service.
  • Product images are provided by merchants and may not exactly represent the actual product.

You should always verify the final price, availability, and product details on the merchant's website before making a purchase.

4. Merchant Responsibility

Each merchant listed on our Service is an independent business. Merchants are solely responsible for:

  • The accuracy of their product information, pricing, and availability.
  • Order fulfilment, shipping, and delivery.
  • Product quality, warranties, and conformity with description.
  • Returns, refunds, and exchanges in accordance with applicable consumer protection law.
  • Customer service and complaint handling.
  • Compliance with all applicable laws and regulations.

We are not responsible or liable for any actions, omissions, products, or services of any merchant.

5. No Endorsement

The listing of a merchant or product on our Service does not constitute an endorsement, recommendation, or guarantee by Omnicliq Digital Agency. We do not verify the quality, safety, or legality of any products offered by merchants, nor do we verify the identity or reliability of any merchant.

6. Affiliate Relationships

In accordance with Law 4933/2022 (transposing Directive (EU) 2019/2161 -- the "Omnibus Directive") and our commitment to transparency:

We may receive a commission or fee from merchants when you click on a product link on our Service and/or subsequently make a purchase on the merchant's website. This is how we fund the operation of our free-to-use comparison service.

These commercial relationships do not influence the ranking or ordering of price comparison results. Product listings are ordered based on objective criteria such as price, relevance, and availability.

The default ranking is based on the following criteria in order of importance: (1) Relevance to the search query (product title matching), (2) Price (lower price = higher ranking), (3) Availability (in stock vs. out of stock). We do not offer paid placements in comparison results. If this changes in the future, promoted results will be clearly labelled.

7. Intellectual Property

All content on this Service that is not merchant product data -- including but not limited to the website design, layout, graphics, logos, text, software, and the underlying source code -- is the intellectual property of Omnicliq Digital Agency and is protected by Greek and EU intellectual property law.

Merchant product data (including product names, descriptions, images, and prices) remains the property of the respective merchants and/or their licensors.

8. Prohibited Uses

You agree not to:

  • Scrape, crawl, or otherwise extract data from our Service using automated tools, scripts, or bots without our prior written consent.
  • Use any robot, spider, site search/retrieval application, or other automated means to access our Service.
  • Attempt to reverse engineer, decompile, or disassemble any part of our Service.
  • Use our Service or its content for any commercial purpose without our prior written permission.
  • Interfere with or disrupt the operation of our Service, servers, or networks.
  • Attempt to gain unauthorised access to any part of our Service.
  • Use our Service in any way that violates applicable Greek, EU, or international law.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Our Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
  • We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Service or your inability to use the Service.
  • We are not liable for any actions, products, or services of merchants, including but not limited to product quality, delivery failures, pricing errors, or refund disputes.
  • We are not liable for any temporary unavailability of our Service due to maintenance, technical issues, or causes beyond our reasonable control.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable EU or Greek law, including liability for fraud or wilful misconduct.

The limitation of liability does not apply in cases of wilful misconduct or gross negligence, in accordance with Articles 332 and 334 of the Greek Civil Code.

10. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Hellenic Republic (Greece) and applicable European Union law. Any disputes arising from or in connection with these Terms or your use of the Service shall be submitted to the exclusive jurisdiction of the courts of Thessaloniki, Greece.

If you are a consumer residing in the EU, you also retain the right to bring proceedings in the courts of your Member State of residence, in accordance with Regulation (EU) No 1215/2012.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

  • Update the "Last updated" date at the top of this page.
  • Display a prominent notice on our website.

Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you should stop using the Service.
